The challenge

The client was arrested in 2025 in Goodyear on a criminal speeding charge in a residential and business district. The original filing was a Class 3 Misdemeanor under ARS § 28-701.02. Even after the underlying matter resolved with the fine paid in full, the arrest record and charging documents remained discoverable. Background checks, landlord screens, and employment vetting routinely surface arrest records regardless of how a case ultimately resolves. For a young client building a career, a public criminal arrest record on a single moving violation is a disproportionate barrier.

Arizona created the sealing remedy in ARS § 13-911 to address exactly this problem. A criminal speeding misdemeanor is eligible for sealing once the case resolves and sentence terms are complete. The application, the prosecutor notice window, and the judge’s review all sit on a clear statutory timeline. Sitting on the eligibility window with a sealable record costs the client every time a background check runs.

What we did

Future First built the Goodyear Sealing Records application around three documented facts. First, the original criminal charge had been reduced to a civil violation under ARS § 28-701(A), and the client paid the fine in full on the day of judgment. Second, the client had no other arrests or criminal incidents in his history. Third, the case posed no public-safety concern that would weigh against sealing under the statute’s best-interests test.

Future First filed the application under ARS § 13-911 in Goodyear Municipal Court along with a law firm support letter detailing why sealing served both the interests of justice and the client’s best interests. The filing waived the hearing request unless the court intended to deny, which is the firm’s standard posture on clean sealing files. The prosecutor and any victims received the statutory 60-day notice. Neither objected.

The court reviewed the application, the Department of Public Safety report, and the petitioner’s history. The judge found the offense eligible, the time frames passed, the sentence terms complete, and the grant in the best interests of the petitioner and public safety. The order granting the sealing application issued 24 days after filing.

If you have an old conviction in Arizona

ARS § 13-911 lets you seal eligible Arizona criminal case records once you have completed your sentence and the statutory waiting period has run. The remedy reaches the arrest record, the charging documents, and the court file. Once sealed, you can lawfully answer that you have not been arrested for, charged with, or convicted of the sealed offense in most contexts under Arizona law.

Eligibility depends on the class of conviction and the time elapsed since you completed your non-financial sentencing terms. Misdemeanor traffic offenses like criminal speeding carry shorter waiting periods than felonies. Some convictions are excluded entirely. The application also has to be filed in the correct court, with the right supporting documentation, and the prosecutor gets a 60-day notice window to object.

Future First handles the eligibility review, the application, the supporting law firm letter, and the prosecutor and DPS notice tracking. We file in the right court, format the application to the AOC form requirements, and follow up if the court sits on the file past the statutory timeline. Sealing a clean record under ARS § 13-911 is one of the highest-value, fastest-moving record relief tools in Arizona.
