The challenge

A set aside changes how an old felony can be used against you. It does not hide the record. The arrest entry, the indictment, the plea, the sentencing minute entry all stay searchable. Employers running background checks still see them. Landlords still see them. The state’s online docket still shows the case.

For a fifteen-year-old felony DUI, the public record was the last barrier. The client wanted the case fully sealed so that the conviction would no longer appear on background searches and would no longer come up in conversations with employers or in his community.

What we did

Future First filed a Petition to Seal Criminal Case Records under ARS § 13-911 with Maricopa County Superior Court. The petition tracked every statutory requirement: the offense was eligible, the timeframes under § 13-911(E) had passed, all monetary terms were paid, all other sentence terms were complete, and sealing served the petitioner’s interest and public safety.

We attached the Order of Discharge from Probation and the Certificate of Absolute Discharge from the Arizona Department of Corrections. The prosecutor took no position on the petition. The Department of Public Safety report came back clean.

The judge granted the petition. The clerk of the court sealed all records tied to the case and transmitted the sealing order to DPS and the prosecuting agency. The conviction no longer appears on public-facing background searches.

If you have an old conviction in Arizona

Arizona’s sealing law under ARS § 13-911 became available in 2023. It allows you to seal records tied to an arrest, charging documents, and convictions once you meet the waiting period for your class of offense. For a Class 4 felony, the wait is five years from completion of all non-financial sentence requirements.

Sealing and set aside are different remedies. A set aside releases you from the penalties of the conviction. Sealing removes the records from public view. Most clients want both. The set aside provides the legal status change. The sealing provides the practical privacy.

The application has to track every statutory factor. Wait periods run from when the court-ordered non-financial requirements ended, not from sentencing date or fine-payment date. Future First handles the full filing, including the eligibility analysis, the records compilation, and the response to any prosecutor objection.
