The challenge

An active term of supervised probation on a felony case restricts travel, employment options, and the client’s ability to start the downstream record removal applications that depend on sentence completion. Set aside under ARS § 13-905 requires completion of every term of the sentence. Sealing under ARS § 13-911 starts its wait period at judge-ordered non-financial completion. Probation termination is the gateway.

The client was performing on probation. Reporting requirements met. Restitution payments current. Counseling completed. Every term satisfied. The remaining probation period was the only thing standing between the client and the next stage of record cleanup.

What we did

Future First filed an Application to Terminate Probation Early under ARS § 13-901(E) in Maricopa County Superior Court. The application documented full performance on probation, full restitution and fee compliance, the absence of any pending criminal matters, and the rehabilitation record built during the probation term.

Early termination applications work best when the application closes every door an opposing prosecutor or skeptical judge looks for. Future First built the application around the statutory factors and tied each one to documented performance during the probation term. The probation officer’s input was incorporated into the application package.

The judge signed the order terminating probation early. The order ends supervision, lifts the active conditions, and starts the clock on the downstream record removal applications. From this point the client can file for set aside, then sealing, on the original conviction.

If you’re on probation for a felony in Arizona

ARS § 13-901(E) lets the sentencing judge terminate probation early when the defendant has performed on the probation term and the statutory factors weigh in favor of release. Early termination requires a sound performance record, full monetary compliance, and the absence of pending criminal matters.

The benefit of early termination is structural. Probation supervision ends. The active conditions lift. The clock starts on the downstream record removal applications. Set aside under ARS § 13-905 becomes available. Sealing under ARS § 13-911 becomes available. The full record cleanup path opens up.

Early termination is not automatic. The application has to show the judge documented performance, not just bare eligibility. The work is in building the application correctly and presenting the probation officer’s input alongside the legal framework.
