The challenge
The client faced misdemeanor charges out of Scottsdale from a 2019 arrest. The case was transferred to Maricopa County Superior Court for a limited procedural step and then sent back to the city court, which dismissed every count in 2021. He was never convicted of anything.
The city court sealed its own records in 2023 on the client’s own petition. The superior court copy created by the transfer stayed public. This was the second case with the same problem, and together the two dockets meant a name search still told a story the dismissals and the sealing order should have ended. Employers and landlords kept seeing dismissed charges that the original court had already put under seal.
What we did
Future First filed a petition to seal the superior court records under ARS § 13-911, asking the court to take notice of the existing city court sealing order and extend the same relief to the records the transfer had created. The petition documented the dismissal of every count, the prior sealing, and the absence of any other criminal history. A prior attempt the client made on his own in 2023 had been dismissed on procedural grounds, so the filing addressed the correct court and posture head on.
The court granted the petition. The signed order found the records eligible, found sealing in the best interests of the client and the public, and sealed all superior court records relating to the case, with the order transmitted to the Department of Public Safety and the prosecutor. The Maricopa transferred case sealing went from filing to grant in 29 days.
With both petitions granted, every court that ever touched the client’s dismissed 2019 cases now holds the records under seal. That is the complete outcome, and it is what a Maricopa transferred case sealing is for: not one more win on paper, but a record that finally reads clean everywhere it is checked.
