The challenge
An old misdemeanor does not expire on its own. The client had a conviction for driving on a suspended license from 1998. Almost thirty years later, it still appeared on background checks. A decades-old traffic misdemeanor can still cost someone a job or a rental, long after the person has moved on.
Arizona law provides a fix. A set aside under ARS § 13-905 vacates the judgment of guilt and releases you from the penalties of the conviction. The record then shows the case was set aside. That is the relief a Phoenix Set Aside Suspended License order provides.
What we did
Future First pulled the old court record, confirmed the sentence was complete, and confirmed eligibility. We filed the application to set aside under ARS § 13-905 in Phoenix Municipal Court and presented the client’s decades of law-abiding conduct since the conviction.
The Phoenix Municipal Court granted the application and set aside the judgment of guilt. The Phoenix Set Aside Suspended License order came through 29 days after filing.
Old cases still qualify. A Phoenix Set Aside Suspended License application succeeds when the record is complete and the statutory requirements are addressed up front, no matter how many years have passed.
What our clients say
Read verified reviews from people we have helped clear their records:
If you have an old conviction in Arizona
It does not matter how old the case is. Arizona lets you apply to set aside a misdemeanor conviction once the sentence is complete. A conviction from the 1990s qualifies the same as a recent one.
The set aside vacates the judgment of guilt and tells the world the case is resolved. For many people it is the step that finally clears a background check that has followed them for years.
The court looks at completion of the sentence, time since the offense, and conduct since. A complete application puts all of it in front of the judge and avoids delay.
