Apache Junction Marijuana Expungement Granted on a Dismissed Case Under ARS § 36-2862

October 12, 2026

The client had a marijuana case from 2013 that the State dismissed. The record still lived in the court system. Future First secured an Apache Junction Marijuana Expungement under ARS § 36-2862 and removed it for good.

The challenge

A dismissed case is not a clean record. The marijuana charge was dismissed in 2013, but the arrest and the charge stayed in the court system and on background checks. Even a dismissed marijuana case can cost someone a job or an apartment when the reader stops at the charge.

Arizona’s Proposition 207 created the fix. ARS § 36-2862 lets people expunge records tied to eligible marijuana conduct, including cases that ended in dismissal. Expungement is stronger than sealing. The records are removed, and the law treats the event as if it never happened. That is what an Apache Junction Marijuana Expungement delivers.

What we did

Future First filed the Petition to Expunge Marijuana-Related Offense Records under ARS § 36-2862 in Apache Junction Justice Court. We identified the eligible charge, documented the dismissal, and served the prosecutor.

The State did not establish that the client was ineligible. The court granted the petition, expunged every record of the arrest and charge, ordered the records sealed, and directed copies to the Department of Public Safety and the prosecuting agency. The Apache Junction Marijuana Expungement order came through 21 days after filing.

If you have an old marijuana case in Arizona

Proposition 207 changed Arizona law. ARS § 36-2862 lets you expunge records for eligible marijuana conduct, including possession of small amounts, marijuana paraphernalia, and cases that ended in dismissal.

Expungement goes further than sealing. A sealed record still exists but is hidden. An expunged record is removed, and you can answer in most situations as though the case never happened.

Eligibility turns on the type and amount of marijuana involved and how the case ended. If you have an old marijuana case in Arizona, even a dismissed one, a Prop 207 expungement is worth pursuing.
